Terms of Service

These Terms of Service ("Terms") govern your use of the LakshaFin application and website ("Service"). By using LakshaFin, you agree to these Terms. If you do not agree, do not use the Service.

1. Nature of Service

LakshaFin is a read-only mutual fund portfolio dashboard. It displays statistical benchmark ratings, portfolio analytics, and computed observations based on your mutual fund data.

IMPORTANT — NOT AN INVESTMENT ADVISOR

LakshaFin is not registered with SEBI as an Investment Advisor, Research Analyst, or Portfolio Manager.
All analytics are statistical observations — e.g., "Fund X trails its category benchmark by 3.1%." This is not a recommendation to buy, sell, hold, or switch any security.
No content in the App constitutes financial advice, tax advice, or a solicitation to transact.
Mutual fund investments are subject to market risks. Past performance does not guarantee future results.
Always consult a SEBI-registered investment advisor before making financial decisions.

2. Eligibility

You must be at least 18 years old to use LakshaFin.
You must be a resident of India or hold Indian mutual fund investments.
By using the Service, you represent that you meet these requirements.

3. Account Aggregator Usage

LakshaFin operates as a Financial Information User (FIU) under the RBI Account Aggregator framework, using Anumati (Perfios) as its Technology Service Provider (TSP).

Data is fetched only with your explicit, OTP-verified consent via the Account Aggregator consent screen.
You can revoke consent at any time. Revocation triggers immediate deletion of all stored analytics.
LakshaFin has read-only access. It cannot initiate transactions, modify accounts, or move funds.
Raw financial data from FIPs (CAMS, KFintech) is processed in-memory and immediately discarded. Only computed analytics are retained.

4. Accuracy of Information

Portfolio data originates from CAMS and KFintech via the AA framework or your uploaded CAS. LakshaFin does not guarantee the accuracy, completeness, or timeliness of source data.
NAV data, benchmark values, and category averages are sourced from public datasets and may be delayed.
Statistical ratings (5★ Leading, 4★ Balanced, 3★ Deviated, 2★ Lagging) are computed observations, not quality judgments or recommendations.
Tax estimates (LTCG/STCG) are informational approximations based on FIFO methodology. They are not tax advice. Consult a tax professional for actual tax obligations.

5. AI Analytics (Laksha)

Laksha AI is a statistical language model (Meta Llama 3.2 1B) running at the edge. It generates natural-language observations about your portfolio data.
AI features are restricted to the Platinum subscription tier (₹299/mo). Free and Silver users do not have access to AI-powered analysis.
AI outputs are informational summaries, not advice. They may contain inaccuracies or misinterpretations.
Laksha AI will never recommend buying, selling, or switching any fund or security.
Do not rely on AI outputs for financial decisions.

5A. MF Central Integration

LakshaFin integrates with MF Central (CAMS / KFintech) to fetch your mutual fund portfolio using PAN and OTP verification.
Your PAN and mobile number are transmitted securely to the RTA network for OTP-based authentication only.
LakshaFin does not store your PAN or mobile number. Only a masked reference (first 2 and last 2 characters) is retained for session display.
Portfolio data fetched from MF Central is processed identically to Account Aggregator data — in-memory processing, zero raw data retention.

6. Platinum Plan Features

Tax Diagnostics: Unrealized capital gains tracking and exit load timelines are estimates based on available data. Not a substitute for professional tax computation.
B2B Access Keys: Third-party integrations (Volt/50Fin for loans, Quicko for tax filing, Ditto for insurance) are provided by independent companies. LakshaFin facilitates access but is not a party to those transactions. Each provider's own terms apply.

7. Web Sandbox

The web version at lakshafin.com operates with mock/demo data only. No real financial data is processed in the browser. Live features require the secure Android application.

8. Prohibited Uses

You agree not to:

Reverse engineer, decompile, or disassemble any part of the Service.
Scrape, crawl, or extract data from the Service by automated means.
Use the Service to generate or distribute investment advice to third parties.
Misrepresent LakshaFin's analytics as financial advice or SEBI-registered recommendations.
Attempt to access other users' data or circumvent security measures.

9. Intellectual Property

LakshaFin's code, design, brand assets, statistical rating methodology, and AI prompt architecture are proprietary. You may not reproduce, distribute, or create derivative works without written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAKSHAFIN AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO FINANCIAL LOSSES FROM INVESTMENT DECISIONS MADE BASED ON INFORMATION DISPLAYED IN THE APP. THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

11. Indemnification

You agree to indemnify and hold harmless LakshaFin, its operators, and service providers from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your reliance on information displayed in the App for financial decisions.

12. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which details data collection, storage, and your rights under the DPDP Act, 2023.

13. Modifications

We may update these Terms at any time. Material changes will be communicated via the App. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
